Privacy policy
This privacy policy describes how MBR Creative OÜ collects, processes and stores personal data when you use bartenders.ee.
The Estonian version is the legally binding one.
1. General provisions
1.1. This privacy policy governs the principles of collecting, processing and storing personal data. Personal data is collected, processed and stored by the data controller, MBR Creative OÜ (hereinafter the data controller).
1.2. A data subject, for the purposes of this policy, is a client or other natural person whose personal data the data controller processes.
1.3. A client, for the purposes of this policy, is anyone who submits a request or booking for Bartender's services through the data controller's website.
1.4. The data controller follows the data-processing principles set out in law, including processing personal data lawfully, fairly and securely. The data controller is able to demonstrate that personal data has been processed in accordance with the law.
2. Collecting, processing and storing personal data
2.1. The personal data the data controller collects, processes and stores is gathered electronically, mainly through the website's request form and by email.
2.2. By sharing their personal data, the data subject grants the data controller the right to collect, organise, use and manage — for the purposes set out in this policy — the personal data the data subject shares directly or indirectly with the data controller by submitting a request or booking on the website.
2.3. The data subject is responsible for ensuring that the data they provide is accurate, correct and complete. Knowingly providing false data is considered a breach of this privacy policy. The data subject must promptly inform the data controller of any change to the data provided.
2.4. The data controller is not liable for any damage caused to the data subject or third parties as a result of the data subject providing false data.
3. Processing clients' personal data
3.1. The data controller may process the following personal data of the data subject:
- 3.1.1. First and last name;
- 3.1.2. Phone number;
- 3.1.3. Email address;
- 3.1.4. The event venue address, where needed to provide the service;
- 3.1.5. Event details (date, guest count, format and other information related to the request).
3.2. In addition to the above, the data controller has the right to collect data about a client that is available in public registers (for example, the business register, where the client is a legal entity).
3.3. The legal basis for processing personal data is Article 6(1)(a), (b), (c) and (f) of the General Data Protection Regulation:
- a) the data subject has given consent to the processing of their personal data for one or more specific purposes;
- b) processing is necessary for the performance of a contract to which the data subject is party, or to take steps at the request of the data subject prior to entering into a contract;
- c) processing is necessary for compliance with a legal obligation to which the controller is subject;
- f) processing is necessary for the purposes of the legitimate interests pursued by the controller or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.
3.4. Processing of personal data according to the purpose of processing:
- 3.4.1. Security — maximum retention period as set out by law.
- 3.4.2. Processing a request or booking — maximum retention period 24 months.
- 3.4.3. Client relationship management — maximum retention period 24 months.
- 3.4.4. Financial activity and bookkeeping — maximum retention period as set out by law.
- 3.4.5. Marketing — maximum retention period 24 months.
3.5. The data controller has the right to share a client's personal data with authorised processors, such as bookkeeping, web hosting and email service providers. The data controller remains the controller of the personal data.
3.5.1. For website statistics and advertising, the authorised processor is Google Ireland Limited (Google Analytics 4 and Google Ads). That data is processed only if you have given the corresponding consent — the cookie policy describes this in detail.
3.6. When processing and storing the data subject's personal data, the data controller applies organisational and technical measures that protect personal data against accidental or unlawful destruction, alteration, disclosure, and any other unlawful processing.
3.7. The data controller retains data subjects' data depending on the purpose of processing, but never longer than 5 years.
4. The data subject's rights
4.1. The data subject has the right to access and review their personal data.
4.2. The data subject has the right to receive information about the processing of their personal data.
4.3. The data subject has the right to supplement or correct inaccurate data.
4.4. Where the data controller processes the data subject's personal data on the basis of consent, the data subject has the right to withdraw that consent at any time.
4.5. To exercise these rights, the data subject can contact the data controller at bartenders@bartenders.ee.
4.6. The data subject may lodge a complaint with the Estonian Data Protection Inspectorate (Andmekaitse Inspektsioon) to protect their rights.
5. Final provisions
5.1. These data-protection terms have been drawn up in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), the Personal Data Protection Act of the Republic of Estonia, and the legislation of the Republic of Estonia and the European Union.
5.2. The data controller has the right to amend these data-protection terms in part or in full, notifying data subjects of changes via the website bartenders.ee.
